Welcome to MangoStudy! These Terms and Conditions ("Terms") govern your access to and use of the MangoStudy website, mobile applications, and other services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

1. Definitions

"MangoStudy" refers to the services provided through our websites, mobile applications, and other platforms.

"User" means a person who uses the Services, including students and educators.

"User Content" means any content you submit, post, or upload to the Services, such as text, images, feedback, quiz responses, and other educational materials.

"User Generated Service Content" means any content you create using the Services' tools or content, including any modifications of or derivative works based on MangoStudy's original Service Content.

"Referral Program" means the program described in Section 6 through which eligible users may earn rewards by referring new customers to MangoStudy.

"Services" refers to all products and services offered by MangoStudy.

2. Eligibility and User Accounts

To use the Services, you must be at least 16 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

Account Creation: You agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the registration form.

Account Security: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify MangoStudy immediately of any unauthorized use of your account. We will not be liable for any loss or damage from your failure to comply with this section.

3. Use of the Services

You are solely responsible for all User Content you make available through the Services. The following are examples of content and uses that are strictly prohibited. We reserve the right to investigate and take legal action against anyone who, in our sole discretion, violates this provision. You agree not to use the Services to:

Upload any content that infringes intellectual property rights or is unlawful, harmful, defamatory, or obscene.
Interfere with or disrupt the integrity or performance of the Services or servers.
Impersonate any person or entity or misrepresent your affiliation.
Use any automated downloading programs, algorithms, or devices, such as robots, spiders, or crawlers, or any similar manual process, to scrape, extract, or index any Content.
Develop, improve, or train any artificial intelligence system, tool, or model using our Service Content or User Content.
Harvest or collect email addresses or other contact information from other users for unsolicited communications or to publish or distribute any advertising or promotional material.
Attempt to access or obtain any content through means not intentionally made available by MangoStudy.
Circumvent or alter any content protections or geographic restrictions.

4. Intellectual Property

MangoStudy Content: All content on the Services, including text, graphics, logos, software, and educational materials ("Service Content"), is the property of MangoStudy or its licensors and is protected by intellectual property laws. You may not copy, modify, sell, or create derivative works from any Service Content without our express written permission. You may not reverse engineer, disassemble, or decompile any software in the Content.

User Content: We do not claim ownership of any User Content you provide. However, by submitting User Content, you grant us (and those we work with) a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to publish, reformat, archive, and otherwise use such User Content in all forms and media. You warrant that you own or otherwise control all of the rights to your Submission.

User Generated Service Content: All rights, title, and interest in and to any User Generated Service Content will be owned by MangoStudy. You hereby assign all intellectual property rights in such content to us. You also irrevocably waive all rights of paternity, integrity, or any other moral rights you may have in the User Generated Service Content.

Submissions: Any questions, comments, or suggestions you provide to MangoStudy are non-confidential. We will be entitled to the unrestricted use and dissemination of these submissions for any purpose without acknowledgment or compensation to you.

5. Payments and Billing

To the extent the Services are made available for a fee, prices are subject to change. We offer one-time payment plans with no recurring charges or automatic renewals. All purchases provide access for the specified duration (30, 90, or 180 days).

Payment Processing: We use third-party payment processors to handle your payment information. We do not store your full credit card details. By using the payment functions of the Services, you agree to be bound by the terms and conditions of the applicable payment processor.

Refunds and Money-Back Guarantee: All payments are one-time charges and are generally final and non-refundable, except as described in our Money-Back Guarantee below or as required by law.

Our 90-day and 180-day access plans come with a "Money-Back Guarantee". For these plans, we offer a remedy to any customer who does not pass their certification exam after using our Services, subject to the following conditions: (a) Course Completion and Platform Use: You must have completed all of the practice exams provided within the MangoStudy platform and scored at least 85% on at least three (3) of them. (b) Eligibility Window: The date of your official score report must be after your purchase date. (c) Claim Process: To make a claim, you must email us a copy of your official score report showing that you did not pass, and your account must show that you completed all of the practice exams and scored at least 85% on at least three (3) of them prior to the date reflected on your official score report. A scan or screenshot of the report is acceptable. (d) Claim Deadline: Your request and official score report must be sent to support@mangostudy.com within 60 days of the date on your score report.

MangoStudy reserves the right to verify your eligibility. If all conditions are met, we will contact you via email and provide you with a full refund of your one-time payment, issued to your original method of payment. If MangoStudy issues a full refund to a User for any reason, the User's access to the Services will be immediately and permanently terminated at the time the refund is processed.

This Money-Back Guarantee is limited to one (1) refund per customer per purchase and applies only to 90-day and 180-day access plans.

6. Referral Program

MangoStudy offers a Referral Program that allows eligible users to earn rewards by referring new customers. By participating in the Referral Program, you agree to the following terms in addition to the rest of these Terms.

6.1 How It Works

Premium users receive a unique referral code. When a new user applies your referral code at checkout, they receive a 40% discount on their purchase. In return, you earn a reward equal to 10% of the amount actually paid by the referred user (after the discount). Referral codes can only be used by new customers making their first purchase.

6.2 Earning and Clearing Period

Referral rewards are subject to a 30-day clearing period from the date of the referred purchase. During this period, earnings are tracked in your account but are not yet eligible for payout. This clearing period exists to account for refunds, chargebacks, and payment disputes. Only cleared earnings (those older than 30 days) count toward your available balance.

6.3 Payouts

You may request a payout of your cleared referral earnings once your available balance reaches a minimum of $25 (USD). Payouts are made exclusively via PayPal to the email address you provide. Payouts are processed manually and may take up to 14 business days. MangoStudy is not responsible for delays caused by PayPal or incorrect payout details provided by you.

6.4 Monthly Earnings Cap

Referral earnings are capped at $500 (USD) per calendar month. Any referral rewards that would exceed this cap in a given month will not be credited to your account. MangoStudy reserves the right to adjust this cap at any time.

6.5 Refund Clawback

If a referred user receives a refund or successfully disputes a charge, the corresponding referral reward will be deducted from your earnings. If your earnings balance is insufficient to cover the clawback, the amount owed may be deducted from future earnings.

6.6 Prohibited Conduct

The following activities are strictly prohibited and constitute a violation of these Terms:

Self-referral: Using your own referral code to obtain a discount on your own purchases.
Fake or fraudulent referrals: Creating fake accounts, using stolen payment methods, or otherwise manipulating the Referral Program to generate artificial referrals or rewards.
Spam and unsolicited communications: Distributing your referral code through spam, unsolicited messages, or any method that violates applicable laws (including anti-spam legislation).
Misleading promotion: Making false, misleading, or deceptive claims about MangoStudy or the Referral Program when sharing your referral code.
Paid advertising of referral codes: Using paid advertising (such as search engine ads or social media ads) to promote your referral code without prior written permission from MangoStudy.

6.7 Fraud Prevention and Suspension

MangoStudy reserves the right, in its sole discretion, to investigate any referral activity and to suspend or permanently revoke your participation in the Referral Program if we suspect fraudulent, abusive, or otherwise improper conduct. In such cases, we may withhold, freeze, or forfeit any pending or unpaid referral earnings without prior notice. Decisions made by MangoStudy regarding suspected fraud or abuse are final.

6.8 Tax Responsibility

You are solely responsible for reporting and paying any taxes that may apply to referral earnings you receive. MangoStudy does not withhold taxes on referral payouts. Depending on your jurisdiction and total earnings, you may be required to report referral income to the relevant tax authorities. MangoStudy may request tax-related information (such as a W-9 form for U.S. participants) and may withhold payouts until such information is provided.

6.9 No Employment or Agency Relationship

Participation in the Referral Program does not create an employment, agency, partnership, or joint venture relationship between you and MangoStudy. You are not authorized to make any representations or commitments on behalf of MangoStudy.

6.10 Program Modifications and Termination

MangoStudy reserves the right to modify, suspend, or terminate the Referral Program, or any aspect of it, at any time and for any reason without prior notice. This includes changes to reward percentages, discount amounts, payout thresholds, clearing periods, and monthly caps. Any earned and cleared balance at the time of termination will be honored, provided it meets the minimum payout threshold and no violations of these Terms have occurred.

7. Mobile Services and Software

Mobile Services: The Services include features accessible via a mobile device. Your wireless carrier's standard charges, data rates, and fees may apply. We are not responsible for any limitations or restrictions imposed by your carrier.

Mobile App License: Subject to these Terms, we grant you a limited, non-transferable, and non-sublicensable license to install and use a copy of our mobile application on one mobile device for your personal use.

Ownership; Restrictions: The software and technology underlying the Services are the property of MangoStudy and its licensors. You agree not to copy, modify, reverse engineer, or sell any part of the software.

Third-Party Distribution Channels: If you obtain our software through a third-party app store (e.g., Apple App Store or Google Play Store), you may be subject to additional terms from that third party. These Terms are between you and MangoStudy only.

8. Third-Party Services and Websites

The Services may contain links or access to third-party services, websites, or resources. MangoStudy does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from these third-party services. Transactions that occur between you and any third party are strictly between you and that third party.

9. Disclaimers and Warranties

We provide the Services using a commercially reasonable level of skill and care. However, MangoStudy and its suppliers and licensors provide the Services and all Content and any Submissions "as is" and without warranties of any kind.

THE INFORMATION PROVIDED THROUGH THE SERVICES IS FOR EDUCATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR LEGAL ADVICE, DIAGNOSIS, OR TREATMENT. Practitioners and researchers must rely on their own experience and judgment.

MangoStudy will not be liable for any injury or damage to persons, animals, or property arising from the use of any ideas, instructions, or procedures found on the Services. We will not be liable for any medical treatment provided by users to their patients, whether or not the Services were used in connection with such treatment.

10. Limitation of Liability

TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL MANGOSTUDY OR ITS SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, PERSONAL INJURY, LOSS OF PROFITS, OR CORRUPTION OR LOSS OF DATA) ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES OR THE CONTENT OR SUBMISSIONS, OR SHALL THE LIABILITY OF MANGOSTUDY OR ITS SUPPLIERS AND LICENSORS EXCEED A SUM EQUAL TO THE FEES PAID BY YOU HEREUNDER.

11. Indemnification

You agree to indemnify and hold harmless MangoStudy and its affiliates, officers, and employees from any and all third-party claims of liability, losses, damages, and costs (including reasonable legal fees) arising out of or in connection with your violation of these Terms or your use of or inability to use the Services.

12. Copyright Complaints

MangoStudy respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, you should notify our Copyright Agent with a written notice containing the information required by law, including a description of the copyrighted work and where the infringing material is located on the Services.

13. Governing Law and Dispute Resolution

All matters relating to your access to or use of the Services, including all disputes, shall be governed by and construed in accordance with the laws of the Netherlands. The exclusive jurisdiction and venue with respect to any action or suit arising out of or pertaining to the subject matter hereof shall be the competent courts located in Amsterdam, the Netherlands.

Any claim arising out of or in connection with your use of the Services must be brought within one (1) year after the event or such claim is barred.

14. Termination

Any license granted to you is effective until it is terminated by either you or MangoStudy. We reserve the right to suspend, discontinue, or terminate a Service, or its availability to you, at any time without notice if you fail to comply with any of the provisions of these Terms. Upon termination, you must cease all use of the Service.

15. Media Release

You acknowledge that any in-person or virtual presentations or sessions you attend in connection with the Services may be recorded, and such material may include your image or audio. You hereby grant to MangoStudy an irrevocable, unrestricted right and license to use your name, likeness, and audio for advertising, promotion, or other lawful purposes, without further compensation or approval.

16. General

No Assignment: You may not assign your rights or obligations under these Terms to anyone.

No Waiver: Failure or delay on the part of MangoStudy to exercise any right or power hereunder shall not operate as a waiver.

Severability: If any provision in these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Changes: We reserve the right to change, modify, or add portions of these Terms at our sole discretion at any time. Your continued use of the Services following the posting of any changes will mean that you have accepted and agreed to the changes.
